In addition, the African-Americans and Latinos constituted approximately 41% and 50% of the prison population in 2001 (Ibid., p. 2), respectively. (Id., p. 3)
Not only do we have an over-criminalization problem in our society (“Judge Sets a New Record,” Human Rights First News, 2002), but we have also had this problem for the past half-century. For example, according to the American Civil Liberties Union, the United States had about 3,000 licensed private prisons on-site in 1996, but by the end of 2003 that number had grown to about 37,000. (See Fox “Private Prisons,” Human Rights First News, 2001). Therefore, we have been imprisoning more people for longer periods of time than we did even in the earlier half of the 20th century. We are not just imprisoning more people, but we are also jailing them for longer periods of time—for example, if a person is sentenced to two years of prison under a 12 year sentence, and that person is incarcerated for six months, he or she is serving a total of 678 days—imprisonment for which that person did not have to serve. (Id.) Further, incarceration rates for racial groups have increased significantly:
The increase in the prison population is as much due to “greater incarceration rates for African Americans as a group as it is due to more people being brought to prison by courts and parole authorities.” The data set forth in this section reflects the continuing increase in the nation‟s prison population that began in the 1970s, and which has resulted in over a 3-fold increase in the number of people in prison. The growth in the number of prisoners was largest among African Americans, who constituted about half the nation‟s prison population in 1996 (Ibid.).
